ACC INDICTS JULIAN CLARKE AND SALLIEU KARGBO OF THE SIERRA LEONE CIVIL AVIATION AUTHORITY ON VARIOUS CORRUPTION OFFENCES

The Anti-Corruption Commission (ACC) on 2nd February, 2021, filed an indictment against JULIAN CLARKE, Human Resource Manager, Sierra Leone Civil Aviation Authority (SLCAA), and of 8 John Lane, Off Campbell Street, Freetown; and SALLIEU KARGBO, Senior Finance Officer SLCAA, and of 19 City Road, Wellington, Freetown, on a total of 9 (Nine) counts of corruption offences bordering on Abuse of Office, contrary to Section 42 (1), Deceiving a Principal, contrary to Section 40 (1), and Conspiracy to Commit a Corruption Offence, contrary to Section 128 (1), of the Anti-Corruption Act, No. 12 of 2008 (as Amended by the Anti-Corruption Act No. 9 of 2019).

JULIAN CLARKE is indicted on 7 (Seven) counts of Abuse of Office, while SALLIEU KARGBO and JULIAN CLARKE are jointly charged on 1 (One) count of Deceiving a Principal and 1 (One) count of Conspiracy to Commit a Corruption Offence.

According to the particulars of offence, between 1st January and 30th December, 2020, JULIAN CLARKE and SALLIEU KARGBO conspired and deceived the Government of Sierra Leone by authoring and signing a bundle of documents containing false information which were forwarded to the Ministry of Foreign Affairs and International Cooperation and the Turkish Embassy for the purposes of facilitating the issuance of Turkish Visas to certain individuals who were purported to be staff of the Sierra Leone Civil Aviation Authority, knowing very well they were not.

The indicted persons are expected to make their first appearance in the High Court of Sierra Leone, Holden at Freetown on 16th February, 2021.

The Commission wishes to reassure the general public of its determination to address public sector corruption and all other levels of corruption throughout Sierra Leone.

Parliament Exposes Scammer

Parliament of Sierra Leone

Following a citizen’s arrest of an alleged scammer, Parliament in an emergency press conference today Thursday 4th February 2021 presented a suspect named: Vandy Von Kallon, a Research Manager at Sierra Leone Maritime Administration to Members of Parliament and the press.

This came in the wake of several allegations pointing to Members of Parliament of demanding monies from presidential nominees before approval. This Parliament is happy for the nabbing of a member of a criminal cartel soliciting funds from the unsuspecting and gullible members of the public by using the names of the Speaker, Deputy Speaker, Leader of Government Business and the Clerk of Parliament.

You may recall that a lot of public notices had emanated from Parliament asking the public not to yield to the demands of either scammers or swindlers extorting monies from them by using the names of Members of Parliament on false pretense.

The Hon. Speaker of Parliament, Dr. Abass Chernor Bundu told newsmen that the unwarranted conduct of the scammers have perpetually put the image of the House into disrepute. Following the arrest of the alleged swindler, Hon. Speaker said in spite of the powers of Parliament, it would forebear and allow the investigation by the police to reach its logical conclusion. Speaking on natural justice, he noted that Parliament would do a thorough follow-up on this matter bordering on its image and reputation. He also congratulated Dr. Austin Demby, proposed Minister of Health and Sanitation for playing a huge role that led to the arrest of the suspect.

Explaining the scenario under which the suspect was arrested, Dr. Austin Demby said he received an anonymous call in United States from someone in Sierra Leone. According to him, the caller introduced himself as the Leader of Government Business demanding $500 from him as humanitarian assistance to finance his mother’s funeral. He complied and wired via Western Union.

On arrival in Sierra Leone, the swindler persistently requested under the same pretense as Leader of Government Business for Five Million Leones to attend his uncle’s funeral in Bo, but this time he said he could only assist with Three Million Leones. Since he could not do orange money transfer, he asked the alleged fraudster to collect the money himself at Radisson Blu Hotel. The suspect in question appeared for the money and was arrested and handed over to the police for investigation. He also said that Vandy Von Kallon is one among a criminal network that should be brought to book for damaging the reputation of Parliament.

The Leader of Government Business, Hon. Mathew Sahr Nyuma said on receiving calls from Dr. Demby, he rushed and met the suspect at Radisson Blu; where he argued that he was sent by the Deputy Speaker of Parliament, Hon. Segepoh Solomon Thomas. The Deputy Speaker was informed via calls, he denied having knowledge of the matter and suspect was handed over to police for investigation.

The Deputy Speaker said he was very passionate about the matter and vehemently promised to personally prosecute the suspect, once it is charged to court. Cognizant of the powers of Parliament, he warned the police not to compromise the matter as he would ensure it reaches its logical conclusion.

Sierra Leone’s President Julius Maada Bio Receives Annual Report from Ombudsman, Assures of Government Support

State House, Freetown, Thursday 4 February 2021 – His Excellency President Dr Julius Maada Bio today received the 2019-2020 annual report from Ombudsman Leon Jenkins-Johnston Esq and assured of his support to the institution’s independence and operations.

“My Government has supported the legal rights to government information, repealed obnoxious laws that proscribe free speech, and made transparency an administrative norm. These and my Government’s support for the work of the Ombudsman clearly serve the public interest, strengthen our public institutions, and further consolidate a more inclusive democracy, he said.

President Bio also noted the challenges highlighted by the Ombudsman, including the issues of capacity, financial, logistical and other needs contained in the report, and assured him that government would address them because the institution was invaluable to the country’s development.

He said he was further gratified at the restatement by Mr. Jenkins-Johnston Esq of their values of being independent, collaborative, accessible, fair, impartial, just, transparent, reliable, and effective in resolving disputes as well as identifying and addressing attendant structural problems in public administration.

“So, I see the Office of the Ombudsman as a key institution for strengthening and reinvigorating our democracy. Along with the other institutions like the Ministry of Justice, the Anti-Corruption Commission (ACC), the Human Rights Commission (HRCSL), I see the Office of the Ombudsman as a bulwark for institutional integrity and accountability.

“Be reminded that there may be overlaps in mandate every so often. A complaint against an MDA may constitute an offence in the ACC act or an abuse of rights for the HRCSL. So, map out areas of cooperation and work closely for the good of our citizens and our democracy,” he emphasised.

According to the report, from 1 July 2019 to 30 June 2020, 484 complaints were lodged with the Office of the Ombudsman against various Ministries, Departments and Agencies, with 246 lodged at the Head Office in Freetown, 121 in Bo, 71 in Kenema, 16 in Makeni and 30 in Port Loko. 329 have been concluded so far.

The Office of the Ombudsman receives, investigates, mediates and resolves complaints laid against administrative decisions, malpractices of the public sector, institutions of higher learning set entirely or partly out of public funds.

400 Years of Servitude

Poet Oumar Farouk Sesay’s latest collection of poems titled, ‘400 years of servitude’ is a superb reflection on race relations. Poem after poem, the poet mourns the dehumanisation of man through slavery and shares an exile’s pain ofseparation. He mourns with victims of genocide and serves as a dissenting mouthpiece against racial inequality. Wherever men haggle over slaves at an auction block; deny humans their fundamental rights; and, wherever wreaths adorn tombs; be it at a farewell prayer or in the observance of a minute silence for lives claimed by ethnic cleansing for lives claimed by ethnic cleansing, this poet is there.

His cry of universal pain starts from Eden to the mass graves of classical Greece; from the cane-fields of Missouri across the blood spills of the Atlantic; be it on a tour of the dungeons of Goree or at Bunce island; in a nursing home, or a New York subway; in a political speech or; be it in a newspaper caption or an excerpt from books; from quotes of writers or a TV subtext, or in a political campaign or song; this poet cries for humanity’s failure to accept his black children at the tableof brotherhood.

There are songs of triumph over adversity as in, ‘The woman who danced’ and ‘I’m a man,’ both poems do pay homage to the resilience of the black race despite some ‘four hundred years of servitude.’Oumar Farouk Sesay is a Sierra Leonean poet, playwright, and novelist. He works in the private sector, and he is currently the President of PEN, Sierra Leone chapter. His poem, “Song of the Women of my Land,” is on the Literature-in English syllabus for the West African Senior School Certificate Examination.

PARLIAMENT APPROVES MINISTER OF LANDS, FOUR OTHERS

The Parliament of Sierra Leone has on Tuesday 2nd February 2021 approved with unanimity the Ninth Report of its Committee on Appointments and Public Service, chaired by the Leader of Government Business, Hon. Mathew Sahr Nyuma.

The following presidential nominees were approved by Parliament:

1. Dr. Turad Senesie, Minister, Ministry of Lands and Country Planning

2. Rev. Dr. Jonathan Titus Williams-Deputy Minister, Ministry of Planning and Economic Development

3. Dr. Sao-kpato Hannah Isata Max-Kyne – Commissioner, National Commission for Social Action (NaCSA)

4. Jimmy Batilo Songa- Deputy Commissioner, National Commission for Social Action (NaCSA) and

5. Pa. Komrabai Maylie Kamara-Member Board of Directors, Sierra Leone Airport Authority (SLAA)

Seconding the motion, the Opposition Whip, Hon. Hassan Sesay said the approval of presidential nominees is a national duty and spoke well of a lady in respect of gender balance. The Opposition Whip said he had no doubt in the competence of the NaCSA Commissioner. “Let us always give women the support they require”, and went on to remind her of serving the nation sincerely by doing the needful relating to market projects. He also advised the Deputy NaCSA Commissioner to give unreserved support to the female Commissioner for the national good.

The Opposition Whip asked the Lands Minister to stand up and assured him of their support in respect of attaining a positive agenda.

The Deputy Speaker of Parliament, Hon. Segepoh Solomon Thomas alluded to the good work of the Committee on Appointments; adding that all the nominees are laced with outstanding performances. The Deputy Speaker also used the occasion to recommend two nominees because of good performance. However, he expressed disappointment over the country’s lagging behind in lieu of decades of appointments without realizing the desirable outcomes. “I know Dr. Turad Senesie as a perfectionist”. “I am pretty sure that he will heal the wounds of that Ministry”. He went on to speak on dubious activities relative to land grabbing in the country.

Rev. Dr. Titus Williams, he said had a wealth of experience in planning and empathized that he had no doubt in him. “The two people are the best for the positions”, he vehemently concluded.

The Committee Chairman for NaCSA, Hon. Dr. Roland Kargbo commended President Bio for appointing the nominees. However, he decried the outputs of some previous nominees in respect of deliverables. He also urged the nominees to change the drive in light of better performance. Hon. Dr. Kargbo highlighted the development projects of NaCSA in light of monitoring. He was pleased with the appointment of NaCSA’s new Commissioners and Minister of Lands.

Hon. P.C. Bai Kurr Kanagbaro Sanka III, representing Tonkolili District buttressed the position of the Deputy Speaker regarding dubious attitude by the citizenry relating to land. “I am appealing to the nominees to think Sierra Leone”; adding that every compatriot has right to your designated offices and urged them to work in their best interest.

The PC passionately appealed to the Minister of Lands to put stringent measures in place to curb rampant wildfire in the country.

He also commended the Minister of Lands for his good attributes and competence. He advised the Minister to work with Parliament in order to succeed. He also heaped praises on the Deputy Commissioner of NaCSA and admonished all the nominees to respect MPs in the course of executing their duties.

Leader of the Opposition, Hon. Chernor R. M. Bah said the nominees have good CVs but they would not rely on that; adding that performance in new offices matters. He also admonished the nominees to serve best in the national interest.
“All of them are competent on papers”.

The Opposition Leader asked colleague MPs to support and protect the Minister of Lands to deliver on his new appointment.

Leader of Government Business, Hon. Mathew Sahr Nyuma thanked all MPs for their brilliant contributions in light of team work. He re-echoed the incompetence demonstrated by some previous nominees; thus affected the progress of the country.
The Leader of Government Business also commended the new NaCSA Commissioner for astute leadership in national service; and advised her to put the records straight with regards policy and transformational team work. He asked the Deputy Commissioner of NaCSA to work collaboratively with the Commissioner.

For the Ministry of Lands, he alluded to the positive response by way of lecture they had from the new Minister during the course of his interview. He called on MPs to embark on effective and efficient oversight in that regard. He empathized on performance by the nominees in light of the New Direction’s Manifesto or stand to be fired by President Bio if they failed to deliver on their appointments.

The Rt. Hon. Speaker of Parliament, Dr. Abass Chernor Bundu extended congratulatory messages to the nominees and advised them to work in accordance with the confidence reposed on them by the President and the Parliament of Sierra Leone.

Ambassador Sesay Discusses Ports and Maritime Development in Sierra Leone

Abu Dhabi, United Arab Emirates, Tuesday 2 February 2021

Sierra Leone’s Ambassador to the United Arab Emirates, UAE, Rashid Sesay, has met with Authorities of the Abu Dhabi Ports to discuss issues relating to the development of the Ports and Maritime sectors in Sierra Leone.

Situated in Abu Dhabi, Capital of the UAE, Abu Dhabi Ports is a provider of world-class integrated ports and industrial zone services and acts as a business enabler to provide vital infrastructure for the global maritime industry. They also provide a host of marine services to support the maritime industry, using the latest ports equipment.

During his presentation, Ambassador Sesay said that he was engaging the leadership as a way of fostering partnership and collaboration between the Abu Dhabi Ports and its Sierra Leonean counterparts. He added that Sierra Leone and the UAE had established a very good relationship, noting that there was a need to further collaborate through investments for the good of the two nations.

 

He also mentioned that Sierra Leone was losing a lot through illegal fishing and other unauthorized activities in its waters and added that the small-West African nation would welcome collaboration in the area of surveillance equipment to monitor its maritime activities.

 

“Working with you and tapping from your experience will help us develop our Ports and Maritime sectors, especially with skills transfer and equipment. We also need training for our people in maritime and ports service managements,” he said.

 

On his part, Acting Head of Maritime Cluster at the Abu Dhabi Port, Captain Maktoum Al Houqani, said that they had an expertise in maritime and ports management through using the right technologies and processes, in which they would be ready to work with Sierra Leone.

He noted they had the capability as well as the willingness to invest and a strong commitment to support the Government of Sierra Leone. He also added their objective was to invest in tangible developments in the ports management in Sierra Leone and also expressed interest for exchange visits with their counterparts to explore further ways of cooperation.

The Second firs Lady
H.E Madam Hannah Monmoh wife of former President Joseph Saidu Momoh was a low key figure who never under takes any development activities true out her tenured in office as a first lady. During Madam Hannah Momoh tenured as first lady she stayed with her Husband Joseph Saidu Momoh at Wilberforce road. However, when the extent of her husbands infidelities came to light, she left him and moved to London in 1989.

Sierra Leone’s third(3rd) first lady was one of the country’s foremost Lawyers Madam PATRICIA KABBAH.
Madam Lawyer Kabbah had been the chairperson of the committee that restored Sierra Leone to civilian rule and she helped redraft country’s constitution in 1995 when her late husband Dr. Ahmed Tejan Kabba won the election, she sought to set up the first office of the first lady in history of Sierra Leone. Her husband pushed into pressured from Stalwarts in the SLPP party and denied her request. Later in 1998 Patricia Kabbah died of Cancer.
Shortly, after her death her husband Late Dr. Ahmad T Kabba married Madam Isata J. Kabbah.

The 4th first Lady was H.E Isata Jabbie Kabbah took over late Patricia Kabbah who died in London from cancer until she occupied the office of the first Lady till 2007, yet still the office of the first lady was completely dormant with know developmental initiative activities.. Isata Jabbie Kabbah forced herself into the internal politics of the SLPP and created so many enemies, which sh later joined the NGC ahead of 2018 elections when the SLPP regained power…

In 2007, Madam Sia Koroma, a Biochemist and Psychiatric Nurse became the 5th First lady of Sierra Leone. Madam Koroma successfully established the office of the first lady and completely redefined the role, Her husband former president Dr. Ernest Bia Koroma never gave her the full support to make the office of the first lady useful. Madma Koroma worked on three (3) initiatives, the WISH to support mother’s and children, FLAXIX to provide training, and the DANKE Koroma foundation, her husband Ernest Bia Koroma refused to support and grants her request to implement her development agenda for the office of the first lady, which left the office of the first lady less important and unpopular to majority of Sierra Leoneans..

Two years to the national election Former first lady Madam Sia Nyuma Koroma was know were to be seen with her Husband Former president Dr Ernest Bia Koroma in official events as first lady, She later decided to keep low profile because her husband failed to creates the platform for her to implement most of its pending projects.

HUMAN RIGHTS COMMISSION OF SIERRA LEONE PRESS STATEMENT ON THE YENGA BORDER CONFLICT AND THE CLOSURE OF THE GUINEAN BORDER

The Human Rights Commission of Sierra Leone (HRCSL) came into being following recommendations from the Lomé Peace Accord and Report from the Truth and Reconciliation Commission. In 2004, Government by an Act of Parliament accordingly enacted the Human Rights Commission of Sierra Leone Act which gives HRCSL the primary responsibility to protect and promote human rights of all in the country devoid of region, ethnicity, sex, religion, association etc. In this vein HRCSL also serves as a peace building infrastructure which identifies early warning signs of conflict, documents them and make appropriate recommendations to government and its partners for prevention of any potential conflict.

About two weeks ago while monitoring the media, HRCSL noted that some people who said are residents of Yenga, a small village in the Kissi Teng Chiefdom in Kailahun District alleged through a voice message sent on WHATSAPP that Guinean soldiers had crossed over to their town laying claims to it. They, therefore, gave government through the same voice message an ultimatum to act fast and stop the Guineans otherwise they would take the law into their hands. This reopened fresh discussions in the media over the Yenga Border conflict which many Sierra Leoneans had thought it had long been resolved.

HRCSL viewed such threats as an early warning sign for conflict and therefore on the 28th of January 2021 dispatched a team to undertake a fact-finding mission led by the Vice-Chairperson Victor I. Lansana Esq. and Commissioner Hassan Samba Yarjah to Yenga and also had to cross over to Nongowa the border axis of Guinea by means of a canoe. With the Guinea Border remaining closed, the Team also investigated the impact of this continuous closure. Accordingly, HRCSL engaged stakeholders separately on both sides of the border and did a conducted tour of the border area, the Yenga Community and the Pengu Bengu checkpoint. These engagements and conducted tour were aimed at identifying the human rights issues prevailing in that part of the country in a bid to advise government appropriately.

From these engagements and conducted tour, HRCSL has documented the following findings:

1.     Security

·       There is no security presence at the Sierra Leone border along the Makona/ Moa river as opposed to the Guinean counterpart who have a huge military presence at the foot of the border (Moa River).

·       Security presence on the Sierra Leone part is only found at the Pengu Bengu Check Point, which is about 5 miles away from the actual border crossing point.

·       Even at the Pengu Bengu Check Point, security presence is very low.

·       Residents of Yenga community complained of intimidation and harassment from Guinean security personnel.

·       There is no Guinean military occupation of Yenga, the Guineans only crossed the border to come and erect a beacon that was destroyed as a result of the road construction

·       The Guinean personnel consider the area where the beacon is erected as a buffer zone and are determined to prevent anyone from meddling in that area.

2.     Economic and Social Rights

·       There is no presence of any school, health and market facilities in the Yenga border axis;

·       Residents complained that sometimes they are prevented by the Guinean security personnel from using their land for farming and other agricultural purposes;

·       Residents complained that they are normally asked to pay dues by the Guinean authorities to enable them undertake cross-border trade;

·       Residents complained of extortion by the Guinean security personnel during this period of restriction of movement of people across the border

·       Residents complained that the Guinean security personnel demolished the only primary school serving the Yenga Village.

3.     Development Rights

·       GoSL has commenced road construction from Kailahun town to the Yenga border axis

·       Residents complained that Guinean security personnel did not allow the erection of street Solar poles, which had been brought by GoSL and Partners to provide light to the community and its environs

Recommendations

HRCSL notes that these infringements contradict both national and international laws, for instance, Section 1 of the Constitution of Sierra Leone 1991, provides that “Sierra Leone is a Sovereign Republic …”, which means that any encroachment or interference into its territory is an act of aggression and it negates the enjoyment of fundamental human rights and freedoms.

Also, Part two of the Constitution and other relevant statutes and policies guarantee the enjoyments of Economic, Social and Cultural Rights.

Additionally, Article 1(1) & (2) of the ICESCR provides that:

1. All peoples have the right of self-determination. By virtue of that right they freely determine their political status and freely pursue their economic, social and cultural development.

2. All peoples may, for their own ends, freely dispose of their natural wealth and resources without prejudice to any obligations arising out of international economic co-operation, based upon the principle of mutual benefit, and international law. In no case may a people be deprived of its own means of subsistence”.

In light of the above HRCSL makes the following specific recommendations:

That GoSL should:

1.     Employ with utmost urgency diplomatic channels to resolve the Yenga border conflict once and for all.

2.     Increase security personnel at the Pengu Bengu Check point.

3.     Deploy security personnel at the mouth of the Makona/Moa river, which is the colonial boundary between Sierra Leone and Guinea from that end

4.     In the long term erect permanent structures around the border axis in a bid to make it an economic hub

5.       As matter of urgency, provide social amenities including school, health centre, market and a community centre in Yenga.
6.       HRCSL calls on the Yengah community especially the youth to desist from using any violent means to claim their rights over the Yengah territory.
